A U.S. Court of Appeals has overturned a lower court rulingagainst the claim of a 40-year-old Georgia man who was denied employment to bea police officer with the Atlanta Police Department (APD) because of his HIV-positivestatus, according to a Lambda Legal statement. The suit, filed by the plaintiffunder the pseudonym “Richard Roe,” has been remanded back to district court.Scott Schoettes, director of Lambda Legal’s HIV Project, says, “Before theappellate court, the City of Atlanta admitted that there are alreadyHIV-positive police officers serving on the force; now they need to explain whyour client should be treated any differently.”
